The Services
1. The Carer will provide the Services in an attentive, reliable and caring manner, using reasonable skill and care, taking into account any information provided by the Client to the Carer at the time of entering into the Contract.
2. The Carer shall act in accordance with all reasonable instructions given to it by the Client to the extent practical.
3. A change in a pet’s routine and circumstances can cause distress and unpredictable or abnormal behaviour. The Carer understands this and will offer comfort and reassurance whilst trying, as far as practically possible, to maintain their normal daily routines.
4. In the event of extreme weather or an unforeseen event arising which may have an adverse effect on the Pet(s) including, but not limited to extreme heat/cold or thunderstorm, the Carer shall, at their sole discretion, take whatever action they consider necessary, in their opinion.
The Property
5. The Client gives the Carer permission to access the Property to provide the Services for the Pet(s).
6. The Client agrees to the Carer holding a key to the Property or collecting the key from a secure location at the Property. If instructed to hold the key, the Carer will maintain possession of the Client’s key in a secure lock box. The Client can request to have the key returned at any time.
7. The Client agrees to provide any alarm codes that are necessary to access the Property and the Carer will keep any information in relation to alarm codes secure as per GDPR Rules.
8. The Client agrees to maintain a safe environment for the Carer to conduct the Services; and if the environment or Pet(s) become unsafe then the Carer reserves the right to make other arrangements to complete the Services in a safe manner.
9. The Carer agrees to clean up after the Pet(s) to the extent that would be reasonably expected of a carer carrying out similar services. This shall include washing the Pet(s) food/water bowls, cleaning litter trays and proper disposal of Pet(s) waste. The Client shall ensure that there is an appropriate supply of litter and bags for that purpose, and indicate their preferred method/location of disposal. The Carer will not be responsible for any house cleaning not directly related to the Services.
The Pet(s)
10. The Client confirms that the Pet(s) is not aggressive. Should the Pet(s) become aggressive or dangerous, the Carer shall, in their sole discretion take whatever action they consider appropriate in the best interest of the Pet(s) and other relevant animals or people. In such situations, the Carer reserves its right to immediately terminate the Contract.
11. If your Pet(s) become ill during the care of the Carer the Client will be informed as soon as practically possible.
12. In the event of an emergency, the Client authorises the Carer to initiate appropriate treatment until the Client (or emergency contact) can be reached. All effort will be taken to take the Pet(s) to their registered veterinary practice. Should this not be possible the Carer has the right to take your Pet(s) to the nearest veterinary practice for treatment.
13. If utilising the pet taxi/dog walking service the Carer is not liable for any road traffic accident that should occur while transporting the Pet(s) to any location. The Client agrees to the Pet(s) being transported in a van with other animals (species will not be mixed for the comfort of the Pet(s)).
14. Unless paying for a single dog walk, the Client agrees to group walking of no more than 3 other dogs.
Payment
15. The Carer will charge the Client for the Services as set out in its Price List on its Website (the “Fees”) and the Client agrees to pay the Fees 7 days in advance of the start date of the Services.
16. Pursuant to the Late Payment of Commercial Debts Act 1988 (as amended in 1998 and 2002), the Client reserves its right to impose late payment fees if more than 3 days overdue.
17. Should any payment due under this Contract remain unpaid for 7 days after it falls due, the Carer will be relieved of its contractual obligations to provide the Services until such time as payment is made, and the Client may lose its allotted slot.
18. The Client agrees to reimburse the Carer for any additional fees incurred in carrying out the Services, including, but not limited to, emergency care, unexpected visits, transportation, housing, food or supplies on proof of a valid receipt.
Cancellations/Changes
19. The Client can cancel the Services with by WhatsApp or telephone call (07778953427):
◦ 1 weeks’ notice (7 calendar days) at no cost;
◦ 3-5 days notice at 75% of the Fees;
◦ 1-2 days notice at 50% of the Fees; and
◦ less than 24 hours at 100% of the Fees.
20. Any changes to the dates/times of the Services must be notified at least 1 week before the start of the Services. The Carer shall however use its best endeavours, depending upon their availability, to accommodate any changes to the dates/times of the Services notified to them less than 1 weeks’ notice.
21. The Carer will notify the Client 24 hours before the start of the Services if they have to make any changes or cancellations and issue a full refund where applicable. The Carer reserves the right to cancel at short notice in an emergency/extreme circumstances and issue a full refund for the Services.
22. The Carer shall ensure that it has in place suitable and valid insurance that shall include Public Liability Insurance relative to the services it provides to its client(s).
23. It is the Client’s responsibility to ensure that the Property, its content and its Pet(s) are adequately insured throughout the duration of the Contract.
24. The Carer accepts no liability for damage caused by your Pet(s). The Client will be liable if the Carer or a third party is injured by your Pet(s).
25. If the Carer’s vehicle or property is damaged by the Pet(s), other than reasonable wear and tear, the Client agrees to make good such damage.
Indemnity and Liability
26. The Client will indemnify the Carer against any damage or injury caused by the Pet(s) towards any property, person or other animal, this will include but is not limited to veterinary, medical or legal fees.
27. The Carer shall not be responsible for any damage caused to the Property or possessions or that of others caused by the Pet(s) during the period the Pet(s) are in its care. The Client agrees to indemnify the Carer against any such claims as may be made against it arising out of or in connection with this clause.
28. If the Client requests that the Pet(s) be let outdoors unsupervised the Carer is not liable if the Pet(s) does not return to the Property. The Carer will notify the Client if the Pet(s) does not return and will not be held liable for such an occurrence.
29. The Carer accepts no responsibility or liability for the security of the Property, or any loss or damage which may be sustained as a result of actions taken by third parties who also have access to the Property before, during or after expiry of the Contract.
30. The Carer cannot be held liable for any loss, illness or injury of the Pet(s) whilst in its care, nor for any death of the Pet(s), unless the Carer can be shown to be negligent.
31. The Carer is not liable for the Pet(s) medical bills incurred. The Client agrees to pay and indemnify the Carer against any and all related expenses associated with medical treatment of the Pet(s).
Photographs
32. The Carer will provide updates, photographs and videos during the Services through WhatsApp. The Client agrees to the Carer taking photographs and videos of the Pet(s). The Client agrees to the Carer using the photographs and videos for content on social media. The Carer will never post personal details or photographs/videos or details of Pet(s) while the Client is on holiday. The Client can request the deletion of social media posts or stored photographs/videos at any time.
Data Protection
33. In accordance with GDPR Rules (Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (United Kingdom General Data Protection Regulation)) your personal information will be held on a secure system and you will be informed of any breach of that system without undue delay and, where feasible, not later than 72 hours after the Carer become aware of it. The Client has the right to request the deletion of their data at any time.
Governing Law and Jurisdiction
34. The Contract, its formation and any dispute or claims arising from it shall be governed by the laws of England and Wales and be subject to the exclusive jurisdiction of the Courts of England and Wales.
